Terms of platform

These terms are a public offer from IK “AndreTransfer”, reg. no. 41502039438 (hereinafter – the Platform). By submitting a request on the andretransfer.lv website, you (hereinafter – the User) confirm that you have fully read, understood, and unconditionally accepted these Terms.
1. Definitions and Role of the Platform
1.1. The Platform is solely an automated information service (“electronic notice board”). Its only function is to provide a technical environment where Users can post information requests for trips, and independent service providers (hereinafter – Performers) can access these requests.
1.2. The Platform IS NOT a transport company, a taxi aggregator, a dispatch service, or a travel agent. The Platform DOES NOT organize, offer, or control transportation services.
2. Principle of Operation and Allocation of Liability
2.1. The User posts an information request on the Platform. The Platform automatically makes this request visible to Performers.
2.2. If a Performer expresses readiness to undertake the trip, the Platform automatically transmits their contact information to the User (and/or vice versa). At this moment, the Platform’s information service is considered fully and duly rendered.
2.3. All further communication, arrangement of details, and the trip itself occur DIRECTLY between the User and the Performer. The Platform does not participate in or control their communication.
3. User’s Informed Consent and Assumption of Risks
3.1. By submitting a request, the User confirms that they are clearly informed, aware, and voluntarily agree to the following:
a) Performers are independent private individuals and are not employees or agents of the Platform.
b) ATTENTION: The Platform DOES NOT perform any checks on Performers or their documents (including driver’s license, technical inspection, OCTA insurance policy), nor does it verify their authenticity or validity. The Platform only provides the Performer with a technical facility to upload information about these documents to their profile. All responsibility for the truthfulness of this information, as well as for the existence and legal compliance of the documents at the time of the trip, rests SOLELY AND EXCLUSIVELY WITH THE PERFORMER.
c) The User independently and at their own risk decides to enter into a contractual relationship with the Performer.
d) All and any liability (for safety, timeliness, security of life, health, and property) for the trip arises DIRECTLY between the User and the Performer.
4. Limitation of the Platform’s Liability
4.1. The Platform bears no liability for any direct or indirect losses, damages, or claims related to the trip itself. The User agrees to address any claims related to the trip ONLY AND EXCLUSIVELY DIRECTLY to the Performer.
4.2. The Platform’s liability is strictly limited to the provision of the information service. In the case of proven direct material losses incurred by the User solely and exclusively due to a technical failure of the Platform (e.g., transmission of incorrect contact information), the Platform’s liability shall not exceed 50 (fifty) euros.
4.3. The Platform is not liable for the User’s consequential damages (e.g., compensation for airline tickets, hotel costs, lost profits) arising from problems with the trip.
4.4. The User hereby fully and forever releases the Platform from any liability, except for that explicitly stated in clause 4.2.
5. Contractual Relationship and Payment
5.1. The contract for the trip is concluded DIRECTLY between the User and the Performer. The Platform is not a party to this contract.
5.2. The User makes the payment directly to the Performer. The Platform does not process payments.
6. Other Provisions
6.1. The User confirms that before submitting the request, they were informed of the existence of other travel options (taxi, public transport, etc.) and consciously chose to use the Platform to search for a private driver.
6.2. All disputes related to the provision of the Platform’s information services shall be resolved in the courts of the Republic of Latvia.
